1. Definitions

• "Ironbark" / "we" / "us": Ironbark property rental services, operating from 89 Rawai Beach Road, Rawai, Mueang Phuket, Phuket 83130, Thailand.
• "Client" / "you": Any individual or entity that engages Ironbark for a service or submits an enquiry.
• "Services": Southern Coast Furnished Rentals, Rooted Living Search, and Property Guardianship, as described on our website and in service agreements.
• "Agreement": The service agreement entered into between Ironbark and the Client, incorporating these Terms and any written service scope document.

2. Acceptance of Terms

By submitting an enquiry form, signing a service agreement, or engaging Ironbark services in any manner, you confirm that you have read, understood, and agree to these Terms and Conditions. You must be at least 18 years of age and have the legal capacity to enter a binding agreement. These Terms apply to all services provided by Ironbark.

3. Service Description

Ironbark provides property rental-related services in southern Phuket, Thailand, specifically:

• Southern Coast Furnished Rentals: Identification and arrangement of furnished short-term properties (1–12 weeks) in Rawai, Nai Harn, and Chalong, including orientation support.
• Rooted Living Search: Comprehensive home search and tenancy support for stays of six months or more, including property viewings, lease review guidance, and relocation logistics support.
• Property Guardianship: Monthly oversight of a client's rented property during periods of absence, including property visits, vendor coordination, and photographic reporting.

Ironbark acts as a rental intermediary and advisory service. We are not a party to rental agreements between clients and landlords, and do not guarantee property availability, landlord conduct, or tenancy outcomes.

4. Fees and Payment

• All fees are agreed in writing before any service commences. Fee schedules are provided at the time of service engagement.
• Current indicative pricing: Furnished Rentals from ฿10,000/week; Rooted Living Search ฿22,500 (one-time); Property Guardianship ฿5,500/month. Fees are denominated in Thai Baht (THB).
• Payment is due as specified in the service agreement. Late payment may result in suspension of services.
• Ironbark does not accept referral payments from landlords. Our fees are paid solely by the client.

5. Cancellation and Refunds

Cancellation terms are specified in the individual service agreement. General principles:

• For Rooted Living Search, cancellation before viewings commence may entitle a partial refund, less any administrative costs incurred.
• For Property Guardianship, the service may be terminated with 30 days' written notice. Fees for any completed month are non-refundable.
• Furnished rental fees are subject to the terms of the specific property arrangement and may not be refundable once a booking is confirmed.

6. Client Responsibilities

• Provide accurate and complete information when requested.
• Attend scheduled property viewings or provide reasonable advance notice of cancellation.
• Review and sign rental agreements independently before execution; Ironbark's lease review is advisory only and does not constitute legal advice.
• For guardianship clients, provide accurate property access information and notify Ironbark of any changes to property access arrangements.
• Comply with all applicable Thai laws during occupancy of any property.

7. Intellectual Property

All content on the Ironbark website—including text, imagery, and structure—is the property of Ironbark or used with permission. You may not reproduce, distribute, or use our content without written consent. Ironbark grants you a limited, non-exclusive license to access our website for personal, non-commercial use.

8. Disclaimers

Our services are provided in good faith based on available information at the time of delivery. We do not make representations or warranties regarding:

• — The conduct, reliability, or responsiveness of any landlord or third-party vendor
• — The suitability of any property beyond our stated assessment criteria
• — Specific outcomes or results from any rental or home search process

Nothing in these Terms constitutes legal, tax, or financial advice.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Ironbark's total liability for any claim arising from our services shall not exceed the fees paid for the specific service giving rise to the claim. Ironbark is not liable for indirect, consequential, or incidental losses. Nothing in these Terms limits liability for gross negligence or fraud.

10. Termination

Either party may terminate a service engagement by written notice in accordance with the terms of the service agreement. Ironbark reserves the right to terminate services immediately if a client provides materially false information or engages in conduct that is harmful to our team, landlord partners, or third parties.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Thailand. Any disputes arising from or in connection with these Terms or our services shall be subject to the jurisdiction of the courts of Phuket Province, Thailand.

12. General Provisions

• Entire Agreement: These Terms, together with any signed service agreement, constitute the full agreement between parties for the relevant service.
• Severability: If any provision of these Terms is found unenforceable, it shall be modified to the minimum extent necessary, and the remainder shall continue in force.
• Waiver: Failure to enforce any provision does not constitute a waiver of that right.
• Assignment: You may not assign your rights or obligations without our written consent.

13. Changes to These Terms

We may revise these Terms periodically. Where changes are material, active clients will be notified in advance. Continued use of our services following any revision constitutes acceptance of the updated Terms.
